IMPORTANT: BY SUBMITTING PERSONAL DATA TO US AND/OR BY USING OUR DIGITAL/WEB PRESENTS, PRODUCTS, SOLUTIONS, TOOLS YOU GIVE YOUR CONSENT THAT ALL PERSONAL DATA THAT YOU SUBMIT MAY BE PROCESSED BY US IN THE MANNER AND FOR THE PURPOSES DESCRIBED BELOW.

1. INTRODUCTION

This Privacy Policy governs the manner in which KVALITO AG and Affiliates (“KVALITO Consulting Group”) collects, uses, maintains and discloses information collected from users (each, a “User”). This privacy policy applies to all KVALITO site and all products and services offered by KVALITO Consulting Group.

The terms “KVALITO,” “we,” “us,” “our” and “ours” when used in this privacy policy (“Privacy Policy”) includes subsidiaries, divisions, branches, affiliates or companies under the control of KVALITO. The terms “you,” “your” and “yours” when used in this Privacy Policy means any user of our digital/web products, solutions, tools included but not limited to any stakeholders such as partners, clients and suppliers, and candidates.

KVALITO and its subsidiaries (KVALITO) is committed to the appropriate protection and use of personal information of all its’ stakeholders. Please review this Privacy Policy to learn more about how KVALITO processes, controls and protects Personal Data.
Personal Data can be understood as any information that can be used to identify, locate or contact an individual, such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, economic, cultural or social identity of that natural person.

Our intent is to only process and control personal information that is provided voluntarily (with consent) so that we can offer information and/or services to those individuals who have a mutual interest to engage, collaborate, and to do business with us.
Personal information may in exceptional cases, be shared with law enforcement, regulatory, or other government agencies, or to other third parties, in each case to comply with legal or regulatory obligations or requests to protect our rights or property and that of our stakeholders.
If you are a member of KVALITO’ staff (internal and external workers), please consult the KVALITO Policy on the Protection of Personal Information and the Binding Corporate Rules (BCR) which are available on the KVALITO intranet.

This Privacy Policy may be amended periodically. You can of course, always visit this page on our website, to view the updated version.
This Privacy Policy applies in all countries within our international network to ensure that we are complying with all applicable data privacy protections, no matter where you are.

2. Personal data that we collect

CANDIDATE DATA: If you send us your application or curriculum vitae (CV) to apply online for a position with KVALITO and as part of our talent acquisition and management activities, we need to process and control certain information about you to match you with available KVALITO career, project, or assignment opportunities. We only ask for data that will enable us to help you with your career. E.g. (Note: This list is not exhaustive)

  • Age/date of birth;
  • Birth number;
  • Sex/gender;
  • Photograph;
  • Marital status;
  • Contact details;
  • Education details;
  • Employment history;
  • browser name
  • type of computer and other technical information used (such as internet service provider) to access our website
  • IP address;
  • Emergency contacts data relating to dependants;
  • Referee data;
  • Work permit status
  • Nationality/citizenship/place of birth;
  • A copy of your driving licence and/or passport/identity card;
  • Financial information (where we need to carry out financial background checks);
  • Social security number (or equivalent in your country) and any other tax-related information;
  • Diversity information including racial or ethnic origin, religious or other similar beliefs, and physical or mental health, including disability-related information;
  • Details of any criminal convictions if this is required by the prospective employer;
  • Details about your current remuneration, pensions and benefits arrangements;
  • Information on your interests and needs regarding future employment, both collected directly and inferred, for example from jobs viewed or articles read on our website and/or social media sites (e.g. xing, linkedin, facebook);
  • Extra information that you choose to tell us;
  • Extra information that your referees tells us;
  • Extra information that our clients tell us;

CLIENT DATA: If you are a KVALITO client, we need to process and control information about you, or individuals at your organisation, in the course of providing you services such as:

(i) consulting,
(ii) matching candidates to your project or assignment; and/or
(iii) notifying you of content published.

To allow us to do this, we save your contact details (such as name, telephone numbers and email address).

SUPPLIER DATA: If you are a KVALITO supplier, we need to process and control information about you, or individuals at your organisation in the course of working with you together. Examples of supplier data that helps us run our business efficiently are names, telephone numbers email addresses and bank details.

3. How do we collect Personal Data?

CANDIDATE DATA: We collect candidate personal data in three primary ways:

  1. Personal data that you, the candidate, gives to us.
  2. Personal data that we receive from other sources; (see below) and
  3. Personal data that we collect automatically. (see below)

Personal data we receive from other sources.

We also receive personal data about candidates from other sources. Depending on the relevant circumstances and applicable local laws and requirements, these may include personal data received in the following situations:

  • Your referees may disclose personal information about you;
  • Our clients may share personal information about you with us;
  • We may obtain information about you from searching for potential candidates from third party sources, such as LinkedIn, Xing and other web and social media sites;
  • If you ‘like’ our page on Facebook, Xing, Linkedin or ‘follow’ us on Twitter we will receive your personal information from those sites.
    Personal data we collect automatically

To the extent that you access our website or read or click on an email from us, where appropriate and in accordance with any local laws and requirements, we may also collect your data automatically or through you providing it to us.

CLIENT DATA: We collect Client personal data in three ways:

  1. Personal data that we receive directly from you;
  2. Personal data that we receive from other sources; and
  3. Personal data that we collect automatically.

Personal data that we receive directly from you

We will receive data directly from you in two ways:

  • Where you contact us proactively, usually by phone or email; social media and/or via website
  • Where we contact you, either by phone or email, or through any social media / website or through our employees (e.g. our operations managers`, our consultants’ business development activities more generally).

Personal data we receive from other sources
Where appropriate and in accordance with any local laws and requirements, we may seek more information about you or your colleagues from other sources generally by way of due diligence or other market intelligence including:

  • From third party market research and by analysing online and offline media
  • From delegate lists at relevant events; and
  • From other limited sources and third parties (for example from our candidates to the extent that they provide us with your details to act as a referee for them).

Personal data we collect via our website or another other KVALITO (social media) site
To the extent that you access our website or read or click on an email from us, where appropriate and in accordance with any local laws and requirements, we may also collect your data automatically or through you providing it to us.

WEBSITE USERS: When you visit our website, there is certain information that we may automatically collect. such as your IP address, the date and the times and frequency with which you access the website and the way you browse its content. We also collect data from you when you contact us via the website. We collect your data automatically via cookies, in line with cookie settings in your browser.

SUPPLIER DATA: Within our daily business activities we may collect data about you when for example you provide us with personal information directly, when you access our website, or click on an email from us.

PEOPLE WHOSE DATA WE RECEIVE FROM CANDIDATES AND EMPLOYEES, SUCH AS REFEREES: We collect your contact details only where a candidate or an employee puts you down as a referee.

4. How do we use your personal data?

CANDIDATE DATA: Your personal details are used to match you with available KVALITO career opportunities, projects, and assignments. E.g.

  • Talent Acquisition and Management Activities;
  • Marketing, and Sales Activities/ Events;
  • Equal Opportunities Monitoring; and
  • To help us to establish, exercise or defend legal claims.

CLIENT DATA: The main reason for using information about clients is to ensure that the contractual arrangements between us can properly be implemented so that our business relationship runs smoothly. We use client information for:

  • Service scoping/definition
  • Key Account Management Activities;
  • Marketing, and Sales Activities/ Events; and
  • To help us to establish, exercise or defend legal claims.

SUPPLIER DATA: We use certain personal data to ensure that our business relationship can run efficiently, and to comply with legal and contractual requirements. We will only use your information:

  • To store (or update) your details on our database, so that we can contact you in relation to our agreements;
  • To offer services to you or to obtain support and services from you;
  • To perform certain legal obligations;
  • To help us to target appropriate marketing campaigns; and
  • In more unusual circumstances, to help us to establish, exercise or defend legal claims.

5. Who do we share your personal data with?

CANDIDATE DATA: We share your information with prospective clients to increase your chances of matching you with the right career opportunities

CLIENT DATA: We will share your data to ensure that we provide you with a suitable pool of candidates;

SUPPLIER DATA: Unless you specify otherwise, we may share your information with any of our group companies and associated third parties such as our service providers and organisations to whom we provide services.

6. How do we safeguard your personal data?

We care about protecting your information and are committed to adhering to the provisions of applicable data privacy laws and regulations including but not limited to the GDPR. That’s why we put in place appropriate measures that are designed to prevent unauthorised access to, loss and or and misuse of your personal data.

7. How long do we keep your personal data for?

If we have not had meaningful contact with you for a period of several years, we will remove your personal data from our systems unless law or other regulation requires us to preserve it (for example, because of our obligations to tax authorities or in connection with any anticipated litigation).

8. How can you access, amend or take back the personal data that you have given to us?

We will deal with your request promptly, and in accordance with the requirements of any applicable laws. Please note that we may keep a record of your communications to help us resolve any issues which you raise.

Right to object: If we are using your data because we deem it necessary for our legitimate interests to do so, and you do not agree, you have the right to object. We will respond to your request within 30 days (although we may be allowed to extend this period in certain cases). Generally, we will only disagree with you if certain limited conditions apply.

Right to withdraw consent: Where we have obtained your consent to process your personal data for certain activities (for example, for profiling your suitability for certain career opportunities), or consent to market to you, you may withdraw your consent at any time by contacting us.

Data Subject Access Requests: Just so it’s clear, you have the right to ask us to confirm what information we hold about you at any time, and you may ask us to modify, update or delete such information. At this point we may comply with your request or, additionally do one of the following:

  • we may ask you to verify your identity, or ask for more information about your request; and
  • where we are legally permitted to do so, we may decline your request, but we will explain why if we do so.

Right to erasure: In certain situations (for example, where we have processed your data unlawfully), you have the right to request us to “erase” your personal data. We will respond to your request within 30 days (although we may be allowed to extend this period in certain cases) and will only disagree with you if certain limited conditions apply. If we do agree to your request, we will delete your data but will generally assume that you would prefer us to keep a note of your name on our register of individuals who would prefer not to be contacted. That way, we will minimise the chances of you being contacted in the future where your data are collected in unconnected circumstances. If you would prefer us not to do this, you are free to say so.

Right of data portability: If you wish, you have the right to transfer your data from us to another data controller. We will help with this by directly transferring the data to you.

Right to lodge a complaint with a supervisory authority: You also have the right to lodge a complaint with your local supervisory authority.

Right to unsubscribe: if your interests or requirements change, you can unsubscribe from our marketing content (for example emails offers or KVALITO newsletters) by clicking the unsubscribe link in the email.

9. How do we store and transfer your data internationally and ensure data security and integrity?

KVALITO operates internationally – so we may have to transfer or store your data internationally.

In order to provide you with the best service and to carry out the purposes described in this Privacy Policy, your data may be transferred:

  • Between and within KVALITO entities;
  • To third parties (such as advisers or other Suppliers to the KVALITO business);
  • To overseas clients;
  • To clients within your country who may, in turn, transfer your data internationally;
  • To a cloud-based storage provider; and
  • To other third parties

We want to make sure that your data are stored and transferred in a way which is secure. We will therefore only transfer data outside of the European Economic Area or EEA (i.e. the Member States of the European Union, together with Norway, Iceland and Liechtenstein) where it is compliant with data protection legislation and the means of transfer provides adequate safeguards in relation to your data, for example:

  • By way of data transfer agreement, incorporating the current standard contractual clauses adopted by the European Commission for the transfer of personal data by data controllers in the EEA to data controllers and processors in jurisdictions without adequate data protection laws; or
  • By signing up to the EU-U.S. Privacy Shield Framework for the transfer of personal data from entities in the EU to entities in the United States of America or any equivalent agreement in respect of other jurisdictions; or
  • Transferring your data to a country where there has been a finding of adequacy by the European Commission in respect of that country’s levels of data protection via its legislation; or
  • To ensure that your personal information receives an appropriate level of protection, we have signed appropriate agreements with third parties who we may share your personal data with to ensure that it is adequately protected as required by law.

KVALITO controls the processing and controlling of personal data on its web/digital presents, products, solutions and tool.

11. What are cookies and how do we use them?
